Terms of Service

These terms explain the rules for playing our games and using our website. Please read them carefully. Nothing in these terms takes away rights you have under the consumer laws of your country.

1. Agreement to these terms

These Terms of Service ("Terms") are an agreement between you and WayFinder Interactive ("WayFinder", "we", "us"). They apply to the games we publish on any platform (each a "Game") and to our website at wayfinderinteractive.com (the "Website"), together the "Services". By downloading, installing or playing a Game, or using the Website, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

2. Age and eligibility

If you are under the age of majority where you live, you may only use the Services with the permission of a parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use, including any purchases. Some Games may have a minimum age shown on their store page.

3. Your licence to play

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download, install and play our Games on devices you own or control, for your own non-commercial entertainment, in line with these Terms and the rules of the app store you got the Game from. The Games are licensed to you, not sold.

4. Rules of conduct

You agree not to:

  • copy, modify, distribute, sell, rent or sublicense any part of the Services;
  • reverse engineer, decompile or disassemble a Game, except where the law expressly allows it;
  • use cheats, bots, exploits, mods or unauthorised third-party software that interfere with the Services or give an unfair advantage;
  • tamper with ads, purchases, analytics or security features, or attempt to obtain virtual items without paying for them;
  • use the Services for any unlawful, harmful or fraudulent purpose; or
  • remove or alter any copyright, trademark or other notices.

We may suspend or limit access for anyone who breaks these rules.

5. Virtual items and in-app purchases

  • Our Games may let you obtain in-game currency, items, features or the removal of ads ("Virtual Items"), either through play or by paying real money.
  • Virtual Items are licensed to you as part of your licence to play. They have no monetary value, cannot be exchanged for real money and cannot be transferred or sold outside the Game.
  • Purchases are processed by the app store (such as Apple or Google) under its terms. Prices are shown in the store before you buy and may include taxes.
  • Refunds are handled by the app store you purchased from, under its refund policy and applicable law. Contact us if a purchased item was not delivered and we will help.
  • If you live in the EU or UK, you agree that delivery of digital content starts immediately after purchase, and you acknowledge that you therefore lose your statutory right of withdrawal once delivery has started, to the extent the law allows.
  • We may change, rebalance or discontinue Virtual Items as Games evolve. If we stop offering a Game, we will give reasonable notice where required by law. Purchases that unlock permanent features, such as removing ads, can be restored through the Game's "Restore purchases" option where available.

6. Advertising

Free-to-play Games may show ads, including optional rewarded ads that give you Virtual Items for watching. Ads are provided by third parties, and we are not responsible for the content of advertisers' products or websites. Your ad choices are explained in our Privacy Policy.

7. Feedback and content

We love hearing ideas from players. If you send us suggestions or feedback, you allow us to use them freely to improve our Services, without any obligation to you. Any content you share with us must not break the law or anyone else's rights.

8. Intellectual property

The Services, including all code, art, music, characters, names, logos and other content, are owned by WayFinder or our licensors and protected by intellectual property laws. Except for the licence granted in these Terms, no rights are transferred to you. "WayFinder Interactive" and our game titles and logos are our trademarks.

9. Updates and availability

We may update Games to fix bugs, add features or meet legal and platform requirements, and some updates may be required to keep playing. We work hard to keep the Services available, but we cannot promise they will always be uninterrupted or error-free, and some features may need an internet connection. We may change or stop offering a Service at any time, subject to your rights under applicable law.

10. Privacy

Our Privacy Policy explains how we collect and use information, including for analytics and advertising, and the choices you have.

11. Third-party services

The Services may include or link to third-party services, such as app stores, analytics and ad networks. Your use of those services is governed by their own terms and policies, and we are not responsible for them.

12. Disclaimers

To the extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow these exclusions, so they may not apply to you, and you keep any statutory rights that cannot be excluded.

13. Limitation of liability

To the extent permitted by law, WayFinder will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us for the relevant Game or Virtual Items in the 12 months before the claim, and (b) USD 50 or its equivalent in your local currency.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law.

14. Termination

You can stop using the Services at any time by uninstalling our Games. We may suspend or end your access if you seriously or repeatedly break these Terms, or if required by law. Sections that by their nature should continue (such as intellectual property, disclaimers and limitation of liability) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the country in which WayFinder is established, without regard to conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts of that country.

Before starting any formal dispute, please contact us at support@wayfinderinteractive.com so we can try to resolve the issue informally. Most concerns can be solved quickly this way.

16. Additional terms for Apple App Store users

If you downloaded a Game from the Apple App Store, the following also applies:

  • These Terms are between you and WayFinder only, not Apple. WayFinder, not Apple, is solely responsible for the Game and its content.
  • Your licence is limited to use on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide any maintenance or support services for the Game.
  • If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation for the Game.
  • WayFinder, not Apple, is responsible for addressing any claims relating to the Game, including product liability claims, claims that the Game fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
  • If a third party claims that the Game or your use of it infringes their intellectual property rights, WayFinder, not Apple, is responsible for the investigation, defence, settlement and discharge of that claim.
  • You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

17. Additional terms for Google Play users

If you downloaded a Game from Google Play, your use is also subject to the Google Play Terms of Service. Google is not responsible for the Game or for providing support for it.

18. Using our Website

You may browse the Website for personal and business purposes, such as learning about our studio or contacting us about a project. Please do not copy or reuse its content without permission. Information about our services on the Website is for general purposes; any work we do for clients is governed by a separate written agreement.

19. General

  • Changes: we may update these Terms. We will post the new version here with a new effective date and, for significant changes, notify you in the Game or by other appropriate means. Continuing to use the Services after changes take effect means you accept them.
  • Severability: if any part of these Terms is found unenforceable, the rest stays in effect.
  • No waiver: if we do not enforce a right, we have not given it up.
  • Assignment: we may transfer these Terms to a successor, for example if our studio or a Game is sold. You may not transfer them without our consent.
  • Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and us about the Services.
